Wood Pole Services Mobile App Privacy Policy

Preserving your privacy and practicing transparency about how we at Clean Harbors Environmental Services, Inc. (“Clean Harbors”) use your information is critical to earning your trust. The following privacy policy (the “Policy”) is meant to inform you of our policies and procedures regarding the information we collect about you and from you during your use of our services, including but not limited to the Wood Pole Service Mobile App (the “Services”).  This policy does not apply to information that: (a) we collect offline or on any other Company apps or websites, including websites you may access through this App; or (b) you provide to or is collected by any third party, including other apps, websites, or content that may link to or be accessible from or through the Services.

Information Collected

We may collect the following categories of personal information:

  • Identifiers such as your name, phone number, email address, password(s), IP address, and device identifiers
  • Usage Information such as logs, session data, browser and operating system, messaging details, and device identifiers
  • Location or Geolocation Data such as when you use our website or app to provide precise latitudinal and longitudinal points of data to facilitate services from Clean Harbors
  • Inferences (information we may infer about you from other information that we collect)

We may collect personal information through various forms and in various places via the Services, including account registration forms, “contact us forms”, or when you otherwise upload data to and interact with the Services.

Certain parts of Clean Harbors Services allow you to upload or submit ideas, photographs, user profiles, writings, music, video, streamed and recorded audio content, computer graphics, pictures, data, questions, comments, suggestions, information and other content to our platforms (“User Content”). You may upload User Content at your sole discretion, but please note that any User Content that you upload may be publicly available, viewable to others, and may appear in the search results of third-party search engines. Clean Harbors recommends that you do not upload any sensitive personal information, such as information about website accounts, credit card numbers, or your Social Security Number, as that information may be seen by others. 

Whenever you interact with the Services, we or our third-party service providers may automatically receive and record information from your personal computer, browser, laptop, tablet, mobile phone or other device (“Device”) which may include your IP address, geolocation data, device identification, “cookie” information, or the page or feature you requested (“Usage Information”). You may be able to change the preferences on your device to prevent or limit your device’s disclosure of information, but this may prevent you from taking full advantage of some of our features. To the extent we associate Usage Information with personal information we collect directly from you via the Services, we will treat it as personal information.

Usage Information may include: 

  • your IP address, UDID or other unique identifier (“Device Identifier”). A Device Identifier is a number that is automatically assigned to your Device used to access the Services, and our computers identify your Device by its Device Identifier;
  • your Device functionality (including browser, operating system, hardware, mobile network information);
  • the URL that referred you to the Services;
  • the areas within the Services that you visit and your activities there, including remembering you and your preferences;
  • your Device location;
  • your Device characteristics; and
  • certain other Device data, including the time of day, among other information.

Tracking Technologies. We may use various methods and technologies to store or collect Usage Information (“Tracking Technologies”). Tracking Technologies may set, change, alter or modify settings or configurations on your Device. A few of the Tracking Technologies include, without limitation, the following (and subsequent technology and methods later developed): 

Cookies. A cookie is a data file placed on a Device when it is used to access or use the Services. 

Web Beacons. Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) may be included in the Services’ pages and messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Services, to monitor how users navigate the Services, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed. 

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third-party service provider, is active only while you are connected to the Services, and is deactivated or deleted thereafter. 

Browser Fingerprinting. Collection and analysis of information from your Device, such as, without limitation, your operating system, plug-ins, system fonts and other data, for purposes of identification. 

ETag, or Entity Tag. A feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of Device Identifier. ETag tracking may generate unique tracking values even where the consumer blocks certain cookies. 

Recognition Technologies. Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices ins the same user). 

Tracking Technologies Usage. We may use Tracking Technologies for a variety of purposes, including: 

Strictly Necessary. We may use cookies or other Tracking Technologies that we consider are strictly necessary to allow you to use and access the Services, including cookies required to prevent fraudulent activity and improve security. 

Performance Related. We may use cookies or other Tracking Technologies that are useful in order to assess the performance of the Services, including as part of our analytic practices or otherwise to improve the content, products or services offered through the Services.

Targeting Related. We may use Tracking Technologies to deliver content relevant to your interests on the Services and third party sites based on how you interact with our content. This includes using Tracking Technologies to understand the usefulness to you of the content that has been delivered to you. 

Location Tracking.  We may use technology to track your location when using the Services.  Your location data is used exclusively for Services functionality but Clean Harbors may share the tracking location data with third parties. You can choose whether or not to allow the Services to collect and use real-time information about your device's location through your Device's privacy settings.  If you block the use of location information, some components or aspects of the Services may become inaccessible or not function properly. 

Tracking Technologies Choices and Consent. We obtain your consent to our information storage or collection Tracking Technologies by providing you with transparent information in our Privacy Policy and providing you with the opportunity to make a choice to disable cookies as set forth above. Please note that we are not required to obtain your consent to the information collection Tracking Technologies identified above that are strictly necessary. We are giving you detailed notice of the Tracking Technologies and your limited choices regarding them so that your consent is meaningfully informed.

Third Party Tracking and “Do Not Track.” 

There may be other Tracking Technologies now and later devised and used by us in connection with the Services. Further, third parties may use Tracking Technologies in connection with our Services, which may include the collection of information about your online activities over time and across third- party websites or online services. We may not control those Tracking Technologies and we are not responsible for them. However, you consent to potentially encountering third-party Tracking Technologies in connection with use of our Services and accept that our statements under this Privacy Policy do not apply to the Tracking Technologies or practices of such third parties. Also, various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party web sites or online services (e.g., browser do not track signals). Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

Information Third Parties Provide About You

We may, from time to time, supplement the information we collect directly from you via the Services with outside records from third parties for various purposes, including to enhance our ability to serve you, to tailor our content to you and to offer you opportunities that may be of interest to you. To the extent we combine information we receive from those sources with your personal information we collect via the Services, it will be treated as personal information and we will apply this Privacy Policy to such combined information, unless we have disclosed otherwise. In no other circumstances do our statements under this Privacy Policy apply to information we receive about you from third parties, even if they have used our technology to collect it and share it with us.

Use of Collected Information

We use information that we collect about you or that you provide to us, including any personal information to (1) to provide you with information or process transactions that you have requested or agreed to receive, including job inquiries, or for providing general information about our services in response to a request submitted online; (2) to provide you with information via email or in-app notifications about our new service offerings on an ongoing basis, unless you opt out of receiving such emails; (3) to provide the Services and enable you to participate in a variety of the Services’ features; (4) to send promotional or marketing emails to you on behalf of the other businesses or organizations; (5) to process your account inquiry, including verifying your information is active and valid; (6) to improve the Services, to create new service offerings, to customize your experience with the Services, or to serve you specific content that is most relevant to you; (7) to comply with legal obligations; (8) to contact you with regard to your use of the Services and, in our discretion, changes to the Services and/or any of the Services’ policies; (9) for internal business purposes; and (10) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.. 

We may communicate with you via email or in-app notification to verify your account, notify you about certain activity on the Services, inform you of changes to our policies and procedures, or to otherwise facilitate the operation of the Services. 

Disclosure of Information

We will not share your personal information with third parties for direct marketing purposes. We may, however, share non-personal information, such as aggregated user statistics and browsing behavior information, with third parties. We may share the information we have collected, including personal information, as disclosed at the time you provide the information and as described below or otherwise in this Privacy Policy. Clean Harbors may also disclose personal information as follows:

We will provide your information when we are required by law or to protect ourselves. We may provide your information to respond to a court order, subpoena, or government agency or investigatory body request. We may also provide your information to investigate potential fraud. 

We may share information that we’ve collected from you to third parties for business purposes, including contractors, vendors, and partners, to help us deliver the Services to you. We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use subcontractors who need the location and address where the work in which you have engaged us is to be performed.  Third-party analytics and other service providers may set and access their own Tracking Technologies on your Device and they may otherwise collect or have access to Personal Information.  We are not responsible for those third-party technologies or activities arising out of them, nor are we responsible for the effectiveness of or compliance with any third parties’ opt-out options.

Please note that if you submit any of your information to a portion of the Services that is accessible by other users, including an online forum or comment section, other users will be able to see that personally identifiable information. Accordingly, only include information in such submissions that you are comfortable sharing with third parties. 

We reserve the right to access, read, and disclose any information that we believe in our sole discretion is necessary to comply with law or court order; enforce or apply our terms of service, and other agreements; or to protect the rights, property, or safety of Clean Harbors, our employees, our users, or others.

We may share personal information with our affiliates. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.

The Services may contain content that is supplied by a third party, and those third parties may collect Usage Information and your Device Identifier when pages from the Services are served to you.  In addition, when you are using the Services you may be directed to other services that are operated and controlled by third parties that we do not control.  We are not responsible for the data collection and privacy practices employed by any of these third parties or their services and they may be tracking you across multiple sites and may be sharing the results of that tracking with us and/or others.  For example, if you “click” on a link, the “click” may take you out of the Services onto a different site.  These other sites may associate their Tracking Technologies with you, independently collect data about you or others, including personal information, and may or may not have their own published privacy policies.  We encourage you to note when you leave our Services and to review the third-party privacy policies of all third-party websites and exercise caution in connection with them. 

Your Privacy Rights

You as a user of Clean Harbors’ services have choices related to your personal information that we collect, and these rights have different names under different laws. Your rights include the following: (1) access to your personal information, (2) correcting inaccurate information, (3) requesting we delete any of your personal information, and (4) opting out of sales, sharing, and targeted advertising. Some of these rights may not apply to your use of Clean Harbors services because we do not use your personal information for those purposes. To exercise any of your rights related to your personal information, please contact iOSSupport@cleanharbors.com with a subject line of “Privacy Rights Request”. Please include in your email whether you are submitting a request on your own behalf or as an authorized agent on behalf of another individual. If we decide not to take action on your request, you can appeal.  If you exercise your data collection or deletion rights, we will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable (but we may retain prior information as business records).  Please note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons.  If you delete your User Content from the Services, copies of your User Content may remain viewable in cached and archived pages or might have been copied or stored by other Services users.

Data Security & Storage 

We have implemented measures designed to protect your personal information from loss, unauthorized access, and alteration. We endeavor to protect the privacy of your account and other personal information we hold in our records by actively working to prevent unauthorized entry or use, hardware or software failure, and other occurrences that could potentially compromise security and integrity of user information.

You also play a role in the safety and security of your information. Certain parts of our Services are protected by password, and it is your responsibility to keep that password confidential. Please notify us if you suspect that your password has been compromised or accessed by unauthorized parties by contacting iOSSupport@cleanharbors.com.

Age of Users 

If you are younger than 13, you may not download or use any mobile apps provided by Clean Harbors or access or provide any content. If you are a parent of a user who is 13 or older but under the age of 18, you are fully responsible for his or her use of the Services.  We are a general audience service and do not use the Services to knowingly collect personal information from children under the age of 13 that requires parental notice and consent under the Children’s Online Privacy Protection Act (“COPPA”) without parental consent.  In the event that we become aware that we have collected personal information from any child, we will dispose of that information in accordance with COPPA and other applicable laws and regulations. If you are a parent or guardian and you believe that your child under the age of 13 has provided us with personal information without COPPA-required consent, please contact us by sending an email to iOSSupport@cleanharbors.com.

Changes to the Policy

It is our policy to publish any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the primary email address specified in your account or through a notice on the website or app home page. The date of the privacy policy’s most recent update is identified at the beginning of this policy. You are responsible for ensuring that we have an up-to-date active and deliverable email address for you.

State Privacy Rights 

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. 

Many states, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) provide their state residents with rights to:

  • Confirm whether we process their personal information.

  • Access and delete certain personal information.

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).

  • Data portability.

  • Opt-out of personal data processing for:

    • targeted advertising (excluding Iowa);

    • sales; or

    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).

  • Either limit (opt-out of) or require consent to process sensitive personal data.
